Medicaid Liens in Personal Injury Cases

On April 17, 2024 the Virginia Senate and House of Delegates approved House Bill 315 – great news for Virginians with Medicaid assistance. The Virginia Trial Lawyers legislative team worked with delegates Marcus Simon and Jason Ballard to pass the bill and amend the Code of Virginia.

In short, HB315 decreases the amount of time it takes to process Medicaid liens in a personal injury case. Previously, processing time for these Medicaid liens was 12-18 months, significantly delaying payments to the injured parties. Effective January 1, 2025, Medicaid liens in personal injury cases may only take 3-4 months to process, getting settlement money in the pockets of injured Virginians much quicker.
