Failure to Yield Causes Serious Injury

At around 6:40 PM last Thursday evening, one driver’s failure to yield caused a car wreck that injured three children and two adults.

NBC12 News reports that the accident happened on Chamberlayne Avenue near Westwood Avenue in North Richmond after a Dodge Neon sedan failed to yield to a Dodge RAM van. The three children and two adults riding in the van were hospitalized and treated for various injuries.

When driving in the Commonwealth, the obligation to yield is strictly regulated by law. According to the Virginia Department of Transportation, failure to yield in the following situations can result in criminal charges:

  • Failure to drive to the right and stop for police/fire/emergency vehicle
  • Failure to stop for pedestrian with white cane
  • Failure to stop and yield right-of-way
  • Failure to yield right-of-way
  • Failure to yield when turning left
  • Failure to yield to funeral procession

Virginia law requires that where a “Yield Right-of-Way” sign is posted, drivers slow down to a reasonable speed while approaching or entering the intersection before stopping at either a clearly marked stop or yield line, or (in the absence of a stop or yield line) before entering the crosswalk on the near side of the intersecting roadway where the driver has a view of approaching traffic.
